TERMS AND CONDITIONS

§ 1 Scope

These Terms and Conditions apply to all orders placed through our online shop with ARCHV – Inhaber:in Elena Roman, Angerstr. 22, 40593 Düsseldorf, Deutschland (the “Seller”). The version in force at the time of the order applies.

§ 2 Definitions

A consumer is any natural person who enters into a legal transaction for purposes predominantly outside their trade, business or profession. An entrepreneur is a natural or legal person or a partnership with legal capacity acting in the exercise of their trade, business or profession.

§ 3 Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order. By clicking the “order with obligation to pay” button you place a binding order for the goods in the shopping cart. We confirm receipt of your order immediately by automated e-mail. This confirmation of receipt does not yet constitute acceptance of your offer. A purchase contract is only concluded when we expressly declare acceptance or dispatch the goods.

§ 4 Contract Text and Language

We store the contract text and send you the order data and these Terms by e-mail. The languages available for concluding the contract are German and English; in case of doubt the German version prevails.

§ 5 Prices and Shipping Costs

All prices include statutory VAT of 19%. Shipping costs may apply in addition and are shown separately during the order process before you complete the order.

§ 6 Payment

The following payment methods are available:

  • Kredit- und Debitkarte
  • Klarna
  • Shopify Payments
  • Apple Pay
  • Google Pay
  • Sofortüberweisung

Payment may be processed via an external payment service provider. The purchase price is due upon conclusion of the contract unless expressly agreed otherwise.

§ 7 Delivery and Delivery Times

We deliver to the following regions: Deutschland, EU. Shipping is carried out via: DHL. Unless stated otherwise, the following delivery times apply from conclusion of the contract (for advance payment, from receipt of payment):

  • Germany 2–4 Werktage
  • EU 4–7 Werktage
  • international 7–14 Werktage

Partial deliveries are permitted and free of charge for you where reasonable. If a product is unavailable, we will inform you without delay and refund any payments already made.

§ 8 Retention of Title

The delivered goods remain our property until full payment has been received.

§ 9 Right of Withdrawal

Consumers have a statutory right of withdrawal. Details are set out in the separate withdrawal instructions (see “Right of Withdrawal”). Information on the practical handling of returns can be found on the “Returns” page.

§ 10 Warranty / Liability for Defects

The statutory provisions on liability for defects apply. If the purchased item is defective, you are entitled, within the statutory framework, to subsequent performance, a reduction of the purchase price, withdrawal from the contract or damages.

§ 11 Liability

We are liable without limitation for damage arising from injury to life, body or health and in cases of intent and gross negligence. For slightly negligent breach of essential contractual obligations (cardinal obligations), liability is limited to the foreseeable damage typical for the contract. Otherwise liability for slight negligence is excluded. Liability under the Product Liability Act remains unaffected.

§ 12 Data Protection

We process personal data in compliance with applicable data protection law. Details can be found in our separate Privacy Policy.

§ 13 Copyright / Intellectual Property

All content of the shop — in particular designs, graphics, images, texts and trademarks of ARCHV — is protected by copyright and trademark law. Any reproduction, distribution or other use without our prior written consent is not permitted.

§ 14 Governing Law and Jurisdiction

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the law of their country of habitual residence. If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Düsseldorf.

§ 15 Dispute Resolution

We are neither obliged nor generally willing to participate in dispute resolution proceedings before a consumer arbitration board.

§ 16 Amendments to the Terms

The version of these Terms retrievable at the time of conclusion of the contract applies to the respective order. Later amendments do not affect contracts already concluded.

§ 17 Artistic Content (ARTIST SERIES)

Some products feature artwork by independent artists. The copyright in this artwork remains with the respective artists or with ARCHV. By purchasing, you acquire the product for private use; no rights to the artwork itself are transferred. Any reproduction, distribution or commercial reuse of the artwork without the rights holders’ consent is not permitted. Participating artists are credited in an appropriate manner. The contractual details of the collaboration between ARCHV and the artists are not part of these Terms.
